Terms of Sale

1. Terms of Sale
1.1. The trader of the online store glasaken.ee (hereinafter referred to as the Online Store) is Special Work OÜ (registration code 12524903) with the address Laki põik 4, Tallinn.
1.2. The Terms of Sale apply to the rights and obligations arising from the purchase of the goods mentioned in the contract between Glasaken clients (hereinafter referred to as the Client) and Special Work OÜ (hereinafter referred to as the Seller).
1.3. The Seller reserves the right to make changes to the terms of sale and sales prices.

2. Validity of the sales contract, product and price information

2.1. The terms and conditions of sale apply to the purchase of the goods described in the contract.
2.2. The sales contract enters into force after the advance payment has been received in the Seller’s account. In the event of a delay in the advance payment, the Seller has the right to prepare the order according to its operational capabilities. The goods remain the property of the Seller until the cost of the goods is paid in full.
2.3. The prices of the products sold are stated in the contract. VAT of 22% is added to the price.
2.4. The fee for services depends on the location of the buyer and the fee is described to the buyer in the contract.

3. Ordering

3.1. To order, the Buyer must make a price inquiry for the goods. To complete the inquiry, the required data fields must be filled in.
3.2. If the ordered goods cannot be delivered to the Buyer for any reason, the customer will be notified as soon as possible and the money will be refunded.

4. Right to file a claim
4.1. The Seller is liable for any non-conformity or defect of the goods sold to the Buyer that already existed at the time of delivery of the goods and that becomes apparent within two years of the delivery of the goods to the Buyer. During the first year from the delivery of the goods to the Buyer, it is assumed that the defect already existed at the time of delivery of the goods. It is the Seller’s obligation to rebut this assumption. The Buyer has the right to contact the Seller within two months of the discovery of a defect. Defective goods will either be repaired or replaced with new goods.
4.2. The Seller is not liable for defects that have arisen after the goods have been delivered to the Buyer.
4.3. The Seller shall respond to the consumer’s complaint by e-mail within 10 working days.


5. Right of return

5.1. The Buyer may return the goods within 14 days of receipt of the goods.
5.2. If the products are made to order, the right of return does not apply.
5.3. If the goods have been used for a purpose other than what is necessary to verify the nature, properties and functioning of the goods or if they show signs of use or wear, the Seller has the right to reduce the return fee according to the decrease in the value of the goods.
5.4. To return the goods, the Buyer must submit an application for the return of the goods to the Seller and send it to the e-mail address info@glasaken.ee no later than 14 days after receipt of the goods. To exercise the 14-day right of return, the ordered goods must not have been used, damaged, scratched or otherwise damaged. The costs of returning the goods are borne by the Buyer. After receipt of the goods, the Seller will immediately refund the fees received for the goods to the Buyer.
5.5. Upon receipt of the returned goods, the Seller shall refund to the Buyer all payments received from the Buyer under the contract without delay, but no later than 14 days after receipt of the withdrawal form. The Seller may refuse to make refunds until the goods that are the subject of the contract have been returned or until the Buyer has provided evidence that they have returned the goods, whichever occurs first.
5.6. The right of withdrawal does not apply if the Buyer is a legal entity.

6. Processing of personal data

6.1. The seller uses the personal data entered by the buyer (including name, telephone number, address, e-mail address, bank details, etc.) only for processing the order and delivering the goods to the buyer.

7. Dispute resolution
7.1. If the buyer has any complaints regarding the Online Store, they must be sent by e-mail to the address of the relevant office from which the goods were purchased or to the e-mail address: info@glasaken.ee. If the buyer and the Online Store cannot resolve the dispute by agreement, the customer may contact the Consumer Disputes Commission: https://komisjon.ee/et/avalduse-esitamine or the European Union Consumer Dispute Resolution Platform: https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show&lng=ET or resolve the dispute in Tartu County Court.
